Terms of Use Agreement and Privacy Policy

This Terms of Use Agreement (“Agreement”) is made and entered into by and between RDIconnect, Inc. and you (Subscriber). This Agreement sets forth the standards of use of the RDIconnect Community Online Service (“Service”) for Registered Subscribers. By using the RDIconnect website (“Website”) and the Service, Subscriber agrees to the terms and conditions of this Agreement. If you do not agree to the terms and conditions of this Agreement, then immediately cease all usage of the Website and the Service. We reserve the right to modify, alter, or update the terms and conditions of this Agreement at any time.

Modifications shall become effective immediately upon being posted at www.rdiconnect.com. Subscribers will be notified that a change has been made. We will notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your account or by placing a prominent notice on our site. Your continued use of the Service after amendments are posted constitutes an acknowledgement and acceptance of the Agreement and its modifications. Except as provided in this Paragraph, this Agreement may not be amended.

1.      Description of Service

RDIconnect, Inc. is providing Subscriber with access to the Website and Service that includes various and specific groups, resources, discussion forums and live events depending on the level of membership. We make available the most current version of the RDI® Program Protocol to Subscribers who work with consultants. Subscriber must provide (1) all equipment necessary for their own Internet connection, including computer and modem and (2) provide for Subscriber’s access to the Internet. (3) Subscribers or their consultants will be responsible for payment of any fees related with such connection.

2.      Disclaimer of Warranties

The site is provided by RDIconnect, Inc. on an “as is” and on an “as available” basis. RDIconnect, Inc. shall have no liability for any interruptions in the use of this Website.

In this regard RDIconnect, Inc. is committed to maximizing the availability and functionality of the Website and the Service and resolving any interruption or downtime as quickly as possible.

3.      Modifications and Interruption to Service

Although RDIconnect, Inc. will make every attempt to provide continuous, uninterrupted and secure access to our website, and subscriptions, Subscriber acknowledges and accepts that operation of the Website and Subscriptions may be interfered with or adversely affected by numerous factors or circumstances outside of our control.

4.      Subscriber Accounts

Unlike our public website, all Subscribers of the Service shall receive a password and an account. Subscriber agrees to notify RDIconnect, Inc. of any unauthorized use of Subscriber’s account or any other breach of security known that should be known to Subscriber. Subscriber’s right to use the Service is personal to the Subscriber. Subscriber agrees not to provide unauthorized copyrighted content, resell or make any commercial use of the Service. RDI® Certified Consultants and Consultants-in-training are free to make use of the Service in connection with any services provided to a client who is also a current subscriber to the Service.

Subscribers will be given the ability to choose what information is being shared with the RDIconnect Community, including their own identity. For the features that do contain an option to share information with the RDIconnect Community, Subscribers will be able to select a default level of permission as well as item level permission for each entry. Features that will not have the option of being shared with the RDIconnect Community are:  individual demographic information, private calendar items, Consultant Private Notes, private blogs, private chats and feedback between consultant and client.

In the course of Certified Training for the RDI® Program, Consultants-in-training are required to participate in Professional Supervision. During Professional Supervision, the Consultant-in-training must ask two of their clients to participate as a Supervision Family. If the family does participate as a Supervision Family, their account will be periodically reviewed by an RDIconnect, Inc. Training Supervisor in order to evaluative the CITs work. In this case, the Subscriber must give consent for this arrangement and will give the Consultant auditing privileges to RDIconnect, Inc. Once training is complete, the supervisor would no longer have access to the Supervision Family account.

5.      Term and Termination

Eligibility: All RDI® Certified Consultants and Consultants-in-training in the RDI® Program working with a minimum of one family also subscribed to the Service are eligible to be a Registered Subscriber of the RDIconnect Community and can maintain an account.

Term: The term of this Subscription Agreement shall begin on the date Subscriber makes payment and agrees to the terms of use for the Service. In the case of third party payors who are required to be billed, a guarantee of payment must be secured. In the case of a scholarship, the scholarship must be accepted and finalized by RDIconnect, Inc. The length of the initial term will be one month. Subscriptions are non-refundable.

Renewal / Termination: Subscriptions will automatically renew on a month-to-month basis at the end of the initial term unless intentionally terminated by Subscriber. In order to terminate a subscription, RDIconnect must be notified at least 3 business days before the end of the current term (via e-mail:billing@rdiconnect.com; or via phone: 713-838-1362).

Consultant withdrawing or removed from the RDI® Program: In the event that a consultant voluntarily withdraws or is removed from the RDI® Program, RDIconnect, Inc. will work with Subscriber to keep their account active in the Service and help them find another consultant if desired.

6.      Payment Terms

Subscriber shall pay RDIconnect, Inc. the total Subscription Fee. Subscribers who are unable to pay by credit card or who need to make special arrangements for 3rd party payors need to contact RDIconnect, Inc. to make those arrangements on a case by case basis (via e-mail: accounting@rdiconnect.com; or via phone: 713-838-1362)

7.      Usability and Training for the Service

The Service was designed so that Subscribers would be able to begin using the system immediately. Online video tutorials and printable materials are provided for instructional support. Live Webinars available on future dates will be announced. Subscribers can also receive support by emailing RDIconnect, Inc. Technical support staff will attempt to respond to technical support emails on business days (Monday-Friday) by e-mail within 24 hours or as soon thereafter as is reasonably practical. Questions emailed on Fridays may be answered the following Monday. Additional training will be available to subscribers during workshops with dates and times to be announced.

8.      Third-Party Sites or Products

Our website may include links to other sites or products on the Internet that are not owned and operated by RDIconnect, Inc.

Subscriber acknowledges that RDIconnect, Inc. is not responsible for the availability of, or the content located on or through any third-party site and Subscriber should contact the site administrator or webmaster for those third-party sites with concerns regarding such links or the content located on such sites.  Subscriber’s use of those third-party sites is subject to the terms of use and privacy policies of each site, and RDIconnect, Inc. is not responsible therein.  RDIconnect, Inc. encourages all Subscribers to review said privacy policies of third-party sites.

RDIconnect, Inc. makes no warranties or representations whatsoever with regard to any product provided or offered by any third-party, and you acknowledge that any reliance on representations and warranties provided by any third party shall be at your own risk.

9.      Limitation of Liability

RDIconnect, Inc. shall not be liable for any damages whatsoever, and in particular RDIconnect, Inc. shall not be liable for any special, indirect, consequential, or incidental damages, or damages for lost profits, loss of revenue, or loss of use, arising out of or related to the Service or the Website or the information contained in it, whether such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise, even if RDIconnect, Inc. has been advised of the possibility of such damages.

10.    Indemnification

Subscriber and website user agrees to indemnify and hold RDIconnect, Inc., its parents, subsidiaries, affiliates, officers and employees, harmless from any claim or demand, including reasonable attorneys’ fees and costs, made by any third party due to or arising out of Subscriber’s use of the Service, the violation of this Agreement, or infringement by Subscriber, or other user of the Service using Subscriber’s computer, of any intellectual property or any other right of any person or entity.

11.    Governing Jurisdiction of the Courts of Texas

The Service and the Website are operated and provided in and from the State of Texas. As such, it is subject to the laws of the State of Texas, and such laws will govern this Terms of Use, without giving effect to any choice of law rules. Accordingly, if Subscriber chooses to access the Website and/or use the Service, Subscriber agrees to do so subject to the internal laws of the State of Texas.

12.    Compliance with Laws

Subscriber assumes all knowledge of applicable law and is responsible for compliance with any such laws.  Subscriber may not use the website, social media or subscription service in any way that violates applicable state, federal, or international laws, regulations or other government requirements.  Subscriber further agrees not to transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national or international law or regulation.

13.    Content

Content submitted or made available in subscribed publicly accessible (‘public’ meaning only to general subscribers to the RDIconnect Community service) non-private or non-permission restricted areas on RDIconnect Community.

“Publicly accessible” areas of the RDI® subscribed Website are differentiated from the non-subscribed www.rdiconnect.com are those areas that are intended to be available to the general Subscriber with the RDI® community.  By way of example, publicly accessible areas include features that currently offer the option of privately sharing content with the RDI® community such as: public blogs, video, non-video resources, public chats, message boards and webinars.

Publicly accessible features that will not have the option of being shared with the RDI® community are: individual demographic information, private calendar items, consultant private notes, private blogs, private chats, feedback between consultant and client.

Chat Rooms/Message Boards/Bulletin Boards/Blogs/News Groups: This Site may provide Subscriber with access to a wide variety of discussion forums, bulletin boards, chat areas, news groups, “blogs,” or other message or communication facilities (collectively, “Communities”).  All messages, comments, opinions, videos, photographs, creative works or other material posted on the Site (collectively “Postings”) are the sole responsibility of the person who created the Posting, or the person hosting that Community.  Postings do not reflect the views of RDIconnect, Inc. and RDIconnect, Inc. has no obligation to monitor, edit or review any Postings on the Site.  However, RDIconnect, Inc. reserves the right and will take such action as it deems appropriate or necessary to comply with any applicable law or regulation of this Agreement, including but not limited to editing, refusing to post, or removing any Posting or other material, in whole or in part, for any reason, in its sole discretion.

RDIconnect, Inc. does not endorse or support any opinions expressed in the Communities, nor does it represent or guarantee the truthfulness or accuracy of any information posted in the Communities.

Termination of account: RDIconnect, Inc. may, in its sole discretion, terminate account(s) if it believes Subscriber have violated any of the Community Rules, the Copyright Infringement Policy set forth below, or any other provision in this Agreement.

No obligation to monitor:  RDIconnect, Inc. has no obligation to monitor or control the Communities, except to respond to customer service inquiries.  However, RDIconnect, Inc. reserves the right to take such action as it deems appropriate or necessary to comply with any applicable law or regulation, or this Agreement, including but not limited to editing, refusing to post, or removing any Posting or other material, in whole or in part, for any reason, at its sole discretion.

RDIconnect, Inc. does not claim ownership of content submitted or made available for inclusion on the Website or as part of the Service. However, with respect to content submitted or made available for inclusion on publicly accessible areas in non-private or non-permission restricted areas of Website and Service, Subscriber grants RDIconnect, Inc. the following worldwide, royalty-free and non-exclusive license(s), as applicable: to use, distribute, reproduce, modify, adapt, publicly perform and publicly display such content and to incorporate such content into other works in any format or medium now known or later developed.  Subscriber also grants RDIconnect, Inc. the right to use any of Subscriber’s information for research purposes with the understanding that RDIconnect, Inc. will do so on an anonymous basis.

Prior to repurposing the content submitted or made available to RDIconnect, Inc. every reasonable effort will be made to contact the contributor to discuss its potential use in other works, and consider the implications and sensitive nature of the material selected.

14.    Copyright and Trademark Information

All content included or available on this site, including site design, text, graphics, interfaces, and the selection and arrangements thereof is claimed as copyrightable material of RDIconnect, Inc. and protected by all applicable United States and international copyright laws, with all rights reserved as the property of RDIconnect, Inc. and protected by all available intellectual property rights.  Any use of materials on the Website or Service, including reproduction, modification, distribution, or replication, any form of data extraction or data mining, or other commercial exploitation of any kind, without prior written permission of an authorized officer of RDIconnect, Inc. is strictly prohibited.  Subscribers agree that they will not use any robot, spider, or other automatic device, or manual process to monitor or copy web pages or the content contained therein without prior written permission of an authorized officer of RDIconnect, Inc.

RDI® and Relationship Development Intervention® are registered service marks of RDIconnect, Inc.

In addition, use of trademarks or links to the websites of third parties is not intended to imply, directly or indirectly, that those third parties endorse or have any affiliation with RDIconnect, Inc.

15.    Notification of Claimed Copyright Infringement

Pursuant to Section 512© of the Copyright Revision Act, as enacted through the Digital Millennium Copyright Act, RDIconnect, Inc. designates the following individual as its agent for receipt of notification of claimed copyright infringement.

16.    Other Terms

If any provision of this Terms of Use Agreement shall become unlawful, void or unenforceable for any reason, the other provisions (any partially-enforceable provision) shall not be affected thereby and shall remain valid and enforceable to the maximum possible extent.  Subscriber agrees that this Terms of Use Agreement and any other agreements referenced herein may be assigned by RDIconnect, Inc. at its sole discretion, to a third party in the event of a merger or acquisition.  In the case of a merger or acquisition, subscribers will be notified prior to transfer.  This Terms of Use Agreement shall apply in addition to, and shall not be superseded by, any other written agreement between RDIconnect, Inc. in relation to Subscriber’s participation.  Subscriber agrees that by accepting this Terms of Use Agreement, Subscriber is consenting to the use and disclosure of their personally identifiable information and other practices described in RDIconnect Inc.’s Privacy Statement.

RDIconnect, Inc. is voluntarily committed to a Self Assessment procedure to maintain the privacy standards outlined in this policy.

All employees and data processors who have access to, and are associated with, the processing of personal data, are obliged to respect the confidentiality of our Subscribers’ personal data. Individual records may at times be viewed or accessed by technical support staff members only for the purpose of resolving a problem or a support issue. Employees or staff are required to maintain the confidentiality of the information and are prohibited from using it for any other purpose.

Subscribers who register to use the services offered are required to provide us contact information, such as name, organization name, address, credit card number and expiration date. Credit card information is collected for billing purposes and credit card numbers are not currently stored on RDIconnect, Inc. servers. In the future, if housed on a system that does store credit card numbers for billing purposes, the numbers will be encrypted to protect subscribers’ confidentiality.

Subscribers are responsible for maintaining the confidentiality and security of their user registration and password.

Subscribers can update or remove their personal information at any time by logging into their account and editing their Personal Demographic Information. Subscribers can view their updated profile to confirm their edits have been made.

Subscriber email addresses and any personal information will not be distributed, shared or leased to any third parties. RDIconnect, Inc. will not disclose personal data of Subscribers to other organizations. RDIconnect, Inc. may use Personal Demographic information to provide more effective customer service; eliminating the need for repeated  entry of information; performing research and analysis aimed at improving products, services and technologies; and displaying content that is customized to Subscriber’s interests and preferences. RDIconnect, Inc. will also use personal information to communicate with Subscriber and may send communications such as welcome letters, billing reminders, information on technical service issues and security announcements. RDIconnect, Inc. occasionally sends product surveys or promotional mailings of other products or services available from RDIconnect, Inc.

The RDIconnect Community site does use cookies. A cookie is a text file that is sent from the RDIconnect web servers to a Subscriber’s web browser and stored on the Subscriber’s hard drive. Cookies stored on a Subscriber’s computer do not contain personal data, cannot be used to run programs or delivery viruses to your computer and cannot be accessed remotely by anyone other than RDIconnect, Inc  and its hosting company.

Information will be collected, processed, stored, disclosed and disposed of in accordance with applicable U.S. Law. And may be stored on servers located outside of Subscriber’s resident jurisdiction. U.S. law may not provide the degree of protection for personal information that is available in other countries.

Personal information collected by RDIconnect, Inc in a subscribers account will be available for the subscriber to print and/or save in various formats on their own hard drive while the subscription for the account is in force.  Information collected by RDIconnect, Inc will be maintained up to 45 days after subscription has expired. Exceptions to this policy will be made on a case-by-case basis by contacting RDIconnect, Inc.

RDIconnect, Inc uses Secure Socket Layer (SSL) technology on the log in page to protect against unauthorized access, or alteration of data.  SSL is the industry standard protocol used to deliver secure connect over the Internet.  Unique user names and passwords are required to access a Subscriber’s account and passwords are fully encrypted.  Private groups are created for each family unit subscribing to one of the RDIconnect programs and access to each group is gained by an invitation-only system. All videos maintained by RDIconnect, Inc are in a streaming format only and cannot be downloaded or saved onto a hard drive.  Streaming videos can only be accessed while logged in to www. rdiconnect.com with the appropriate user name and password.

The term “Subscriber” used in the policy and on this site is a general term for all users of the subscription site, including RDI Program Consultants, Consultants in Training and their Clients. The terms are applicable for users who are paying for their subscription to www.RDIconnect.com  or if their subscription is being paid for by a third party as well as users accessing the site during a scholarship or free trial period.

By becoming a Subscriber to RDIconnect Community users agree to respect and protect the confidentiality of the other Subscribers’ information that the Subscriber has been granted access to, especially when accessing information that has a designated restricted access (i.e. Consultants Only).  Subscribers are responsible for maintaining the confidentiality and security of their user registration and password.

The RDIconnect Community at its best will provide a dynamically interactive community where an enormous amount of information about the RDI Program is exchanged. It will also provide a tool for RDI Consultants and their clients to systematically document, store and retrieve highly confidential information. Subscribers will be given the ability to choose what information is being shared with the RDIconnect Community, including their own identity.
